The initialed text of the “Agreement on Establishment of Peace and Inter-State Relations between the Republic of Azerbaijan and the Republic of Armenia” has been released.
The text was published by the Ministry of Foreign Affairs of Azerbaijan.
The agreement consists of 17 articles in total.
The agreement states that the parties, guided by the UN Charter, Declaration on Principles of International Law concerning Friendly Relations and Cooperation among States in accordance with the Charter of the United Nations, the Helsinki Final Act of the the Conference on Security and Cooperation in Europe, and the Alma-Ata Declaration, have agreed to establish peace and interstate relations between themselves.
Key points of the agreed text of the agreement are as follows:
- The parties confirm that the borders between the Soviet Socialist Republics of the former USSR have become the international borders of the respective independent states and are recognized as such by the international community. They recognize and respect each other’s sovereignty, territorial integrity, the inviolability of international borders, and political independence.
- Azerbaijan and Armenia confirm that they have no territorial claims against each other and will not raise such claims in the future.
- Both countries will refrain from the threat or use of force against each other’s territorial integrity or political independence in their mutual relations.
- The parties will refrain from interfering in each other’s internal affairs.
- Azerbaijan and Armenia will establish diplomatic relations with each other.
- Both countries will sign an agreement on the delimitation and demarcation of their state border.
- The parties will not allow the deployment of third-party forces along the mutual border.
- Both sides will combat all forms of intolerance, racial hatred and discrimination, separatism, violent extremism, and terrorism.
- Measures will be taken to resolve cases related to missing persons and enforced disappearances during the armed conflict. This will be addressed in a separate agreement.
- The parties may conclude separate agreements to establish cooperation in various areas, including the economy, transit and transport, environment, humanitarian affairs, and culture.
- This agreement does not prejudice the international legal rights and obligations of the parties under other treaties with UN member states.
- Both countries will be guided by international law and this agreement in their bilateral relations. Neither side may invoke provisions of its domestic legislation to justify non-compliance with the agreement.
- Bilateral commissions will be established to monitor the implementation of the agreement.
- The parties will work to resolve issues directly through consultations, without prejudice to their rights and obligations under international law and treaties binding on them.
- Azerbaijan and Armenia will withdraw and terminate, within one month of the entry into force of this agreement, all interstate claims, complaints, objections, proceedings, and disputes that existed between them before the signing of this agreement.
- This agreement will enter into force after the parties exchange notifications confirming the completion of internal procedures in accordance with their national legislation.
Finally, it is noted that the agreement has been concluded in Azerbaijani, Armenian, and English, with all three texts being equally authentic. In case of divergence in interpretation, the English text shall prevail.
